Acceptance of Terms

By accessing or using FlatRate Pro ("the Service"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, please do not use the Service. Jess Recruiting LLC ("we," "us," "our") reserves the right to modify these terms at any time.

Your Account, Your Responsibility

To use FlatRate Pro, you'll need to create an account. You can use your Google account or sign up with an email and password. You're responsible for keeping your login info safe. Please don't share your account or try to use someone else's - your work history is personal and valuable.

Playing Fair & Prohibited Conduct

We built this app to help you build and showcase your professional work history. We ask that you use it for its intended purpose—tracking your jobs, building your career record, and creating professional reports. Let's keep it a positive and productive tool for everyone's career advancement.

You May Not:

Attempt to hack, reverse engineer, or exploit vulnerabilities in the Service
Use the Service to harass, defame, or harm others
Submit unlawful, infringing, or harmful content
Attempt to bypass access controls, rate limits, or payment systems
Use automated tools (bots, scrapers) without written permission
Share your account credentials or access others' accounts without permission
Violate any applicable laws or regulations

Consequence: Jess Recruiting LLC reserves the right to suspend or terminate accounts that violate these terms, without refund or prior notice.

Premium Feature: Total Voice

The main work history tracking and Professional Report generation are free to use. We offer an optional feature called Total Voice, which lets you speak a job and have AI transcribe the details. Here's how it works:

Access: Access may be included, subscription‑based, or time‑limited. Details may vary by provider.
Secure Payments: Payments are handled by our trusted provider (e.g., Stripe). We never see or store your credit card details.
Access Management: If your payment is successful, your account is marked as entitled to use Total Voice.

Consent to Audio Recording & Transcription

By using voice features, you consent to the recording of your microphone input for the purpose of converting speech to text. Audio is recorded only while you actively engage the recorder. Where supported, audio clips may be securely sent to our server for transcription; otherwise on‑device speech recognition may be used.

Third‑Party Services: We may use trusted processors to provide transcription. Use of such services is governed by our Privacy Policy.
Sensitive Content: Do not include sensitive personal information (e.g., payment card numbers, health information) in dictated content.
Your Responsibility: Ensure you have permission to record in your environment and comply with applicable laws (including any notice/consent requirements).

Acceptable Use of Voice Features

You agree not to use voice features to submit unlawful, infringing, or harmful content. You will not attempt to bypass rate limits, abuse the service, or interfere with others’ use.

Your Data Ownership & Our License

You Own Your Data. All job logs, work history, profile information, and content you input into FlatRate Pro belongs to you.

By using the Service, you grant Jess Recruiting LLC a limited, non-exclusive, worldwide license to:

Host, store, and process your data to provide the Service
Display your data back to you in charts, reports, and analytics
Transcribe voice recordings to text (audio is immediately deleted after transcription)
Create aggregated, anonymized analytics to improve the Service (with all personally identifiable information removed)

Important: This license ends when you delete your data or close your account. You can export your data as CSV or request account deletion at any time by emailing support@jessrecruiting.com.

Your Privacy Matters

We Do NOT Sell Your Data to Third Parties.

Jess Recruiting LLC will never sell your personal information, job logs, work history, or any other user data to third parties. Your data is yours.

We take your privacy seriously. Your work history data is valuable and personal. We've laid out exactly what data we collect and how we use it in our Privacy Policy.

What We Do:

Collect only what we need to make the app work and provide support
Use industry-standard security to protect your data
Allow you to download your complete job history as CSV anytime
Create aggregated, anonymized analytics (with all personally identifiable information removed) to improve the Service and the automotive industry

Your Rights: You can request data export, account deletion, or ask questions anytime by emailing support@jessrecruiting.com.

The "As Is" Clause & Disclaimers

We're constantly working to make FlatRate Pro better, but we can't promise it will be perfect 100% of the time.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

Jess Recruiting LLC makes no warranties, express or implied, including but not limited to:

Merchantability: We don't guarantee the Service is fit for any particular purpose
Availability: We don't guarantee uninterrupted, error-free, or secure access
Accuracy: We don't guarantee data accuracy, especially from third-party integrations (Google, QuickBooks, OpenAI, etc.)
Third-Party Services: We're not responsible for failures, outages, or changes to third-party services we integrate with
Voice Transcription: AI transcription may contain errors; you're responsible for reviewing and correcting transcribed content
Data Loss: While we use industry-standard practices, we don't guarantee against data loss (please export your data regularly)

Your Responsibility: You use the Service at your own risk. Always verify important information and keep backups of critical data.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Jess Recruiting LLC, its officers, directors, employees, and affiliates SHALL NOT BE LIABLE for any:

Indirect damages: Lost profits, lost data, loss of goodwill, work stoppage
Consequential damages: Damages resulting from use or inability to use the Service
Incidental damages: Damages from errors, interruptions, or security breaches
Special damages: Any damages beyond direct damages
Third-party actions: Claims or damages arising from third-party services (Google, OpenAI, Stripe, QuickBooks, etc.)
User content: Any damages arising from content you submit or actions you take
Data issues: Inaccuracies, loss, or corruption of data

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM (OR $100 USD IF YOU HAVE NOT PAID US ANYTHING).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

Indemnification (You've Got Our Back)

You agree to indemnify, defend, and hold harmless Jess Recruiting LLC, its officers, directors, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

Your use or misuse of the Service
Your violation of these Terms of Use
Your violation of any laws or regulations
Your violation of any third-party rights (intellectual property, privacy, etc.)
Content you submit to the Service (job logs, voice recordings, profile information, etc.)
Any claim that your use of the Service caused harm to a third party

In plain English: If you do something wrong with the app and someone sues us because of it, you're responsible for covering those costs.

Intellectual Property Rights

FlatRate Pro powered by GearGenius.AI™ and all related trademarks, logos, graphics, code, and content (excluding your user data) are the exclusive property of Jess Recruiting LLC and are protected by copyright, trademark, and other intellectual property laws.

You May Not:

Copy, modify, distribute, or create derivative works from the Service
Use our trademarks, logos, or branding without written permission
Reverse engineer, decompile, or disassemble the Service
Remove or alter any proprietary notices or labels

You May: Use the Service as intended under these Terms. You own your data and can export it anytime.

Termination Rights

You Can Leave Anytime: You may stop using the Service and request account deletion at any time by emailing support@jessrecruiting.com. We'll delete your account and data within 30 days (except as required by law or for legitimate business purposes like fraud prevention).

We Can Terminate: Jess Recruiting LLC reserves the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including but not limited to:

Violation of these Terms of Use
Fraudulent, abusive, or illegal activity
Non-payment for premium features
Extended periods of inactivity
Discontinuation of the Service

Effect of Termination: Upon termination, your right to use the Service immediately ceases. We may delete your data after termination, so please export your data before closing your account.

Governing Law & Dispute Resolution

These Terms of Use are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Dispute Resolution: In the event of any dispute arising from these Terms or your use of the Service, you agree to first attempt to resolve the dispute informally by contacting us at support@jessrecruiting.com.

If we cannot resolve the dispute informally within 30 days, you agree that any legal action must be brought in the state or federal courts located in Delaware, and you consent to the exclusive jurisdiction of those courts.

No Class Actions: You agree to resolve disputes on an individual basis only. You waive any right to participate in class action lawsuits or class-wide arbitration.

Changes to These Terms

As the app grows and changes, we might need to update these terms. If we make significant changes, we'll do our best to let you know. By continuing to use the app after the terms are updated, you're agreeing to the new terms.
